Some services offered by Carmen Care are complementary wellness services and are not substitutes for medical examination, diagnosis, or treatment by an appropriately licensed healthcare provider.

Individual responses to wellness services vary. Testimonials, case descriptions, examples, and statements regarding possible benefits represent individual experiences or general information and do not guarantee that another person will obtain the same or similar results. Carmen Care does not promise or guarantee any specific clinical, wellness, functional, or financial outcome.

Descriptions of services on the Website are not a determination that a particular service is appropriate or safe for you. Eligibility and appropriateness are evaluated individually and may require additional consent or clearance.

## 5. Services for Minors

Services may be available to minors when appropriate. A parent or legal guardian must contact Carmen Care, provide any required authorization and health information, and sign all applicable consent documents before a minor receives services. A minor may not independently consent to services or enter into a financial agreement through the Website.

Website Eligibility

You must be at least 18 years old to use this Website or provide contact information through it. A parent or legal guardian may use the Website to obtain information concerning services that may be available to a minor.

Appointments, Cancellations, and No-Shows

Appointments are subject to availability and are not confirmed until Carmen Care provides confirmation.

- Cancellation or rescheduling: At least 24 hours’ notice is required.

- Late cancellation: An appointment cancelled or rescheduled with less than 24 hours’ notice may incur a $50 fee.

- No-show: Failure to attend a scheduled appointment without notice may result in a charge equal to the full price of the scheduled service.

Exceptions may be considered by Carmen Care in its reasonable discretion for emergencies or extraordinary circumstances. Any appointment-specific policy communicated to and accepted by the client will also apply.

Packages, Prepayments, Refunds, and Transfers

Certain service packages may require a deposit, prepayment, or agreed payment plan. The price, including services, payment schedule, and any package-specific conditions will be explained before purchase.

Prepaid service packages do not expire and may be transferred to a member of the purchaser’s family with Carmen Care’s prior approval. A transfer may be denied when a service is not appropriate for the proposed recipient or when clinical, legal, licensing, or safety considerations prevent the transfer. Packages may not be resold.

If a purchaser requests to discontinue an eligible package before using all included services, the value of services already received will be recalculated at Carmen Care’s regular, non-discounted pay-as-you-go price in effect on the package purchase date. The refund, if any, will equal:

> Total amount paid toward the package, minus the regular pay-as-you-go price of services already received, minus the retail price of any products already provided, and minus any other previously disclosed nonrefundable charges.

A refund will never exceed the amount actually paid and will not result in a credit greater than the remaining package balance. If the recalculation equals or exceeds the amount paid, no refund will be due. Any approved refund will be returned using a reasonable method selected by Carmen Care, ordinarily the original payment method when available.

Package refund requests must be submitted in writing to [email protected]. This section does not limit any non-waivable rights provided by applicable law or any different written terms agreed to by Carmen Care.

Payment Plans

Payment plans may be offered only when separately agreed to in writing. The client remains responsible for payments according to the agreed schedule, even if services are paused or discontinued, except as provided by the written payment agreement, the package refund calculation above, or applicable law.

Failure to make a payment when due may result in suspension of future services. Carmen Care does not currently use a third-party financing company.

Wellness Product Purchases

Carmen Care may sell wellness products at its physical location. Products are not currently sold or shipped through the Website. Product availability, instructions, warnings, pricing, and return eligibility may vary by product and will be provided at the time of purchase.

Unless Carmen Care provides a different written return policy at purchase, opened, used, custom, or health-related products are not returnable, except when defective or when return or replacement is required by law. Unopened products may be accepted for return only with Carmen Care’s prior approval and proof of purchase. Product information is educational and is not medical advice.

Email and Text Communications

If you voluntarily provide your email address or mobile telephone number and request or consent to communications, Carmen Care may send you administrative messages, appointment-related communications, educational information, or—when legally permitted—promotional messages.

Consent to receive marketing communications is not a condition of purchasing services or products. Message frequency may vary. Message and data rates may apply. You may opt out of marketing text messages by replying STOP and may request help by replying HELP. You may unsubscribe from marketing emails using the unsubscribe link in the email or by contacting us.

Opting out of marketing communications does not prevent Carmen Care from sending non-marketing communications that are necessary for an existing appointment, transaction, account, legal obligation, safety matter, or other service you requested. Delivery of electronic communications is not guaranteed and may be affected by carriers, internet providers, or other third parties.

Please do not send urgent or highly sensitive health information through ordinary email, text message, or general Website contact features. Our collection and use of information are further described in our Privacy Policy and, when applicable, our Notice of Privacy Practices.

Privacy and Health Information

Your use of the Website is also subject to Carmen Care’s Website Privacy Policy. When Carmen Care handles protected health information in its capacity as a covered healthcare provider, the Notice of Privacy Practices and applicable patient documents govern that information.

These Terms do not replace the Website Privacy Policy, Notice of Privacy Practices, treatment consent forms, financial agreements, product instructions, photo or testimonial releases, or other service-specific documents. If a service-specific written agreement directly conflicts with these Terms concerning that service, the service-specific agreement will control to the extent of the conflict.

Intellectual Property

Unless otherwise stated, the Website and its content—including text, photographs, graphics, videos, logos, service names, educational materials, downloads, course materials, protocols, design elements, and other original content—are owned by or licensed to Carmen Care and are protected by applicable intellectual-property laws.

You may view the Website and print a reasonable number of pages for your personal, noncommercial use. You may not copy, reproduce, republish, sell, distribute, modify, display, create derivative works from, scrape, frame, or commercially exploit Website content without prior written permission from Carmen Care, except as allowed by law.

We strive to provide useful and accurate information, but Website content may occasionally be incomplete, outdated, or contain errors. Services, practitioners, products, prices, hours, and availability may change without notice. We may modify, suspend, or discontinue any part of the Website at any time.

The Website is provided on an “as is” and “as available” basis to the fullest extent permitted by law. Carmen Care does not guarantee uninterrupted, error-free, or secure access to the Website.

Limitation of Liability

To the fullest extent permitted by applicable law, Carmen Care and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, inability to use, or reliance on the Website or third-party links.

Nothing in these Terms waives liability that cannot lawfully be waived or limits any rights or remedies that cannot lawfully be limited. This Website limitation does not replace or expand any separately signed informed-consent or service agreement.

Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful misuse of the Website, your material violation of these Terms, or your infringement of another person’s rights. This section does not require you to indemnify Carmen Care for Carmen Care’s own negligence, unlawful conduct, or other liability that cannot legally be shifted to you.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Before filing a legal action concerning these Terms or the Website, the parties agree to make a good-faith effort to resolve the dispute informally. A written notice describing the dispute and requested resolution should be sent to the contact information in Section 1. If the dispute is not resolved informally, the parties agree to consider nonbinding mediation in Palm Beach County, Florida, before proceeding in court, unless emergency or injunctive relief is reasonably necessary or applicable law provides otherwise.

Any court proceeding arising from these Terms or the Website must be brought in a court of competent jurisdiction in Palm Beach County, Florida, unless applicable law requires another location. These Terms do not require binding arbitration and do not waive the right to a jury trial.

Changes to These Terms

We may revise these Terms from time to time. The updated Terms will be posted on this page with a revised “Last Updated” date. Changes apply prospectively from the date they are posted, unless applicable law requires additional notice or consent. Your continued use of the Website after updated Terms become effective constitutes acceptance of the updated Terms.
